How to Search Cases by Name
Magistrate Court name searches run through the Magistrate Court Case Search. WVPASS covers public Circuit lookup as well. Treat a broad name match as a lead only. Before trusting a hit, compare the county, the court, the filing date, the case type, and the style. Then confirm the record with the right Calhoun County clerk.
- Open the official portal for the court involved.
- In MCR, pass the CAPTCHA and enter both first and last name.
- Review up to the 30 records the portal returns.
- Compare location, filing date, category, disposition, and document list.
- Record the case number and call the responsible Calhoun clerk for validation or copies.
The official MCR interface is shown in the capture below.
A CAPTCHA and a disclaimer guard this free search. Both also warn that results may be incomplete and are not the underlying court documents.
Search Calhoun Circuit Cases in WVPASS
WVPASS covers public Circuit Court cases filed July 1, 1999 and later. Browsing case details is free. Documents cost 25 cents per page plus a nominal card-processing fee. Purchased documents stay in account history for 30 days. The system does not store card data. Check the county, case number, style, filing date, and type before you buy anything. There is no refund for opening the wrong case. If WVPASS fails to load or misses a case you expected, note the time. Then call the Circuit Clerk at 304-354-6910. A missing result can reflect a portal glitch, older coverage, or a non-public classification. It does not prove sealing.
Quick answer: WVPASS browsing is free, but public Circuit documents are paid by the page.
How to Search by Case Number
A case number beats a name, because it separates people who share one. Type every letter, digit, and dash exactly as issued. West Virginia magistrate identifiers can look like ##-M##X-##### or M##M-##########. An archived civil case used a YY-C-NNN-type format. Treat these as field models. They are not a promise that every Calhoun number looks the same.
Match the system to the court. Search MCR for Magistrate Court cases. Search WVPASS for public Circuit Court cases. When a felony began in Magistrate Court and later transferred, keep both numbers and check both systems. A transfer entry does not merge two records into one screen. Call the Magistrate Clerk at 304-354-6698 if the first phase is unclear.
Calhoun Magistrate Search Fields
The judiciary's official search instructions cover name and case-number access, the 30-result cap, and the clerk-copy route.
MCR displays case information but no documents, so its controls matter. Read them this way.
| Field | Type | Required | Notes |
|---|---|---|---|
| CAPTCHA/disclaimer | Gate | Yes | Must be accepted before search. |
| First Name | Text | Not marked | Use with last name. |
| Last Name | Text | Not marked | Broad names may hit the cap. |
| Case Number | Text | Not marked | Best key when known. |
| Submit | Button | Action | Returns case information, not files. |
What a Case Search Shows
A result is an index, not the whole file. MCR can add a chronology along with basic information. It may also list charges or claims, party roles, event schedules, and docket entries. Public Circuit results can expose case details and eligible documents. Read an allegation, motion, or bond entry in context. None of them is automatically a conviction or a final judgment.
| Case ID | The unique identifier used to match the local file. |
|---|---|
| Location | The county and court associated with the matter. |
| Filing Date | When the initiating paper or case was entered. |
| Case Type | The portal's court or matter category. |
| Event Schedule | Date, time, room, location, judge, and closure reason. |
| Disposition | The recorded outcome field, which should be checked against the order. |
| Docket Entry | Filing date, code, description, and filer for a chronological action. |
Formal proof comes from the clerk. Request the judgment, the order, or a certified disposition there, since a free result and a certified court record serve different needs.
Calhoun Payment IDs Are Not Dockets
The Magistrate Court Payment System helps when the goal is a citation or a payment plan. It offers separate routes for Citation ID, Case ID, and Payment Plan ID, and each is an exact-match search where dashes matter. Citation County is optional. A $2 per-payment charge is added.
Payment data can identify an obligation, nothing more. It is not a docket. For the case history or a copy, switch to MCR and the Calhoun Magistrate Clerk.
County vs Statewide Case Search
Calhoun has no single county-only database. Statewide portals and local clerks hold the pieces. The statewide screen helps locate public case information, while the Calhoun clerk validates the local file, supplies documents that are not online, and explains the request route.
| Channel | Coverage | Best use |
|---|---|---|
| WVPASS | Public Circuit cases statewide, 1999 forward | Circuit details and eligible documents. |
| MCR | Magistrate case information statewide | Name or number lookup; no documents. |
| Payment System | Exact magistrate payment identifiers | Citation, case, or plan payment search. |
| Calhoun clerks | Files held by the named local court | Validation, paper copies, certification, older files. |
In person, the Circuit Clerk sits in Suite 205. The Magistrate Clerk sits in Suite 103. Both are at 363 Main Street, Grantsville. Calling works too. A requester may also mail a narrow written request using the instructions provided. Ask for current fees and payment methods before sending any money.
Why Calhoun Clerks Still Matter
The Circuit Clerk keeps Circuit and Family Court files. The Magistrate Clerk keeps the separate Magistrate docket. The County Clerk is a different office. It handles probate, the county commission, elections, vital records, and land work. A misdirected request delays the search.
Official listings disagree on the Circuit Clerk's name and email. The county and Secretary of State show Sheila or Shelia Garretson. Judiciary pages show Maria Arnold. The office phone stays consistent, though. Address requests to the office itself, and call 304-354-6910. Verify the current contact before mailing private details or payment. The Magistrate Clerk listing is steadier, at 304-354-6698.
Give the court, case number, exact document, date range, copy type, delivery choice, and deadline. Ask whether the case is public, non-public, sealed, confidential, or simply outside portal coverage. Clerks can explain the access procedure. They cannot interpret the law or lift a judge's restriction.
Restricted Cases and Access Rules
Some cases stay off WVPASS. Sealed files, confidential matters, and juvenile material are all excluded. West Virginia Code ยง51-4-2 permits public inspection of court records only when no exception applies. Family cases are a good example. West Virginia Family Court Rule 6 keeps most family pleadings, exhibits, recordings, and transcripts confidential. Orders and indices follow different access rules. Juvenile records carry statutory protection. Expunged records are sealed after qualifying relief, not erased, so never assume deletion.
When a restriction applies, the rule and the court process control. The Calhoun clerk cannot quietly reveal protected content or undo a sealing order. Ask which category your case falls into and go from there.
One more caution for any docket search. Results can expose personal data that should not be republished. Use what you find to track your own case, confirm a hearing, follow a public matter, or do historical work. Verify every record with the court that holds it.
When Calhoun Lookup Results Fail
A failed Calhoun County case lookup is not a case outcome. A blank screen or a CAPTCHA error says nothing about the docket itself. The same goes for a loading problem or a thin result list. Write down your search terms and the time. Then check spelling, dashes, county, and court. A case number often works when a name does not. MCR users should remember the 30-result ceiling. If WVPASS will not surface a public Circuit case, contact the Circuit Clerk directly.
Grantsville ordinance matters go to Town Hall at 304-354-7500, since the town posts no official municipal docket portal. Federal cases are different again. Use PACER for the Northern District of West Virginia, because neither WVPASS nor MCR covers ordinary federal litigation. When the search turns up a setting, verify it is still current. The Calhoun County court dates route explains how.
Older Calhoun records may simply fall outside the portal's date coverage. The clerk may hold a paper file, an archived index, a transferred record, or an alternate case number. A mailed inquiry works best when you narrow it. Give the court, the rough filing period, party name, and document type. The clerk is not required to run an unlimited phone search or summarize an entire file. Precision pays.
A Magistrate result can list documents without letting you download any of them. Copy the exact docket-entry description and filing date. Then ask the Magistrate Clerk for the current copy rate and delivery options. For Circuit documents, decide whether a paid WVPASS copy is enough. The receiving office may instead demand a plain, attested, or certified clerk copy. A portal PDF is not automatically certified.
When a matter spans two courts, keep notes. A felony complaint can start under a Magistrate case number and continue as a Circuit indictment. The first docket shows the preliminary phase, while WVPASS carries later pleas, motions, hearings, judgment, and sentence. Relying on one identifier leaves a real gap in the chronology. Ask each clerk whether the case transferred, record both numbers, and then request copies.
Note: Match the court first. Use the most exact identifier you have, and treat the local clerk as the final public-record check.
